WPIC 52.20 Medical Marijuana—Marijuana Plant—Definition
Plant means a marijuana plant having at least three distinguishable and distinct leaves, each leaf being at least three centimeters in diameter, and a readily observable root formation consisting of at least two separate and distinct roots, each being at least two centimeters in length. Multiple stalks emanating from the same root ball or root system is considered part of the same single plant.
NOTE ON USE
Use this instruction only for offenses committed on or after July 1, 2016.
Use this definition when the defense contains a limitation on the number of marijuana plants a person may possess.
Use this instruction if it is helpful to the jury to define a term used in WPIC 52.10 (Medical Marijuana—Qualifying Patient—Defense), WPIC 52.11 (Medical Marijuana—Designated Provider—Defense), and WPIC 52.11.04 (Medical Marijuana—Cooperative—Defense).
