WPIC 36.07.04 Words or Conduct—Definition
“Words or conduct” includes, in addition to any other form of communication or conduct, the sending of an electronic communication.

Use this instruction when it will assist the jury in understanding the elements of the offense of harassment.

RCW 9A.46.020(1)(b). This instruction has been modified for this edition to more closely follow the statutory language.
The Legislature's inclusion of an electronic communication in “words or conduct” was to clarify “that electronic communications are included in the types of conduct and actions that can constitute the crimes of harassment and stalking … [and not] to restrict in any way the types of conduct or actions that can constitute harassment or stalking.” Laws of 1999, Chapter 27, § 1.
