This chapter contained jury instructions for the sentencing phase of a death penalty case. In 2018, the Washington Supreme Court held that Washington's current death penalty procedures are unconstitutional as administered. State v. Gregory, 192 Wn.2d 1, 427 P.3d 621 (2018). Any future imposition of the death penalty will require legislative action. WPIC Chapter 31 is therefore being withdrawn in its entirety.
