WPI 330.47 Employment Discrimination—Pregnancy Discrimination—Certain Reasonable Accommodations Required
Upon request or notice of the need for such accommodation, an employer must provide the following accommodations for an employee who is pregnant or has a pregnancy-related health condition:
[(1)] [Providing more frequent, longer, or flexible restroom breaks] [and]
[(2)] [Modifying a no food or drink policy] [and]
[(3)] [Providing seating or allowing the employee to sit more frequently if her job requires her to stand] [and]
[(4)] [Imposing limits on lifting over 17 pounds].
An employer cannot refuse to provide these accommodations, claim an undue hardship, or require that the employee provide written certification from her health care provider regarding the need for these accommodations.
NOTE ON USE
Use this instruction with WPI 330.44 (Employment Discrimination—Pregnancy Discrimination—Definition) and WPI 330.45 (Employment Discrimination—Pregnancy Discrimination—Reasonable Accommodation—Burden of Proof) when one of the required accommodations is at issue.
