WPIC 50.72 County Jail—Definition
“County jail” means a facility that is [operated] [supervised] [or] [maintained] by a county for the temporary housing of adult persons charged with a criminal offense prior to trial or sentencing and for the housing of adult persons for purposes of punishment and correction after sentencing.

Use this instruction, as applicable, with WPIC 50.71 (Enhanced Sentence—County Jail or State Correctional Facility—Special Verdict).

COMMENT
The Legislature did not define the phrase “county jail” in RCW Chapter 9.94A. This definition is based upon the definition of “jail,” “governing unit,” and “detention facility” contained in the City and County Jails Act. See RCW 70.48.020.
