COMMENT
Previously, this instruction addressed the public interest element for private disputes, while former WPI 310.04 addressed the same element for consumer disputes. In 2009, the Legislature enacted RCW 19.86.093, which set forth a “public interest” test and effectively removed the distinction between private and consumer disputes. Accordingly, the statutory test has been incorporated into WPI 310.04 (Public Interest Element).
