Part III. Issues—Burden of Proof
Chapter 21. Burden of Proof
WPI 21.07 Evenly Balanced Evidence
(The WPI Committee recommends that no instruction be given on this subject.)
COMMENT
The Washington Supreme Court has advised against giving such an instruction. Enyeart v. Borgeson, 60 Wn.2d 494, 498 fn. 2, 374 P.2d 543 (1962) (“In the interest of brevity and simplicity, it is suggested that the trial court reject ‘evenly balanced’ instructions, since the matter is and should be adequately covered by the traditional instruction on burden of proof.”)
