WPI 3.01 Prior Inconsistent Statement or Conduct
(The WPI Committee recommends that no instruction be given on this subject.)
COMMENT
Prior inconsistent statements by a witness are nearly always admissible under ER 613 for the limited purpose of impeachment. Under some circumstances, narrowly defined by ER 801(d)(1), a prior inconsistent statement may be fully admissible as substantive evidence.
A limiting instruction is needed only when the evidence is admissible for impeachment but not as substantive evidence. When a limiting instruction is needed, use WPI 1.06 (Evidence for Limited Purpose). See also the Note on Use and Comment to that instruction.
