ORDER DISMISSING APPEAL1
 
*1 On January 5, 2024, Steel Buffalo, LLC (Petitioner) appealed a determination issued by the U.S. Small Business Administration (SBA) terminating Petitioner's participation in the 8(a) Business Development (BD) program. On March 21, 2024, SBA moved to dismiss the appeal. SBA explains that it has withdrawn the termination decision “because [SBA] determined that it is necessary to complete a further review” of certain documents, and because SBA may request that Petitioner produce additional information pertaining to a change of ownership. (Motion at 2.) Petitioner does not oppose SBA's motion. (E-mail from D. LaPorte (Mar. 22, 2024).)
*1 As there is no longer any live case or controversy for OHA to adjudicate, SBA's motion is GRANTED and the appeal is DISMISSED. 13 C.F.R. § 134.211(e). This dismissal is WITHOUT PREJUDICE to a new appeal being filed in the event that SBA later issues a new termination decision. Subject to 13 C.F.R. § 134.409(c), this is the final decision of the U.S. Small Business Administration. See 15 U.S.C. § 637(a)(9)(D); 13 C.F.R. § 134.409(a).
