HUBZONE APPEAL OF: PAE APPLIED TECHNOLOGIES LLC, APPELLANT RE: LYNKER TECHNOLOGIES LLC

*1 On November 22, 2023, PAE Applied Technologies LLC (Appellant) filed the above-captioned appeal with the U.S. Small Business Administration (SBA) Office of Hearings and Appeals (OHA). The appeal challenged a determination dismissing Appellant's Historically Underutilized Business Zone (HUBZone) status protest against Lynker Technologies LLC (Lynker).

*1 Because the appeal did not allege that the Director of the HUBZone Program (D/HUB) committed any error in dismissing Appellant's protest, OHA ordered Appellant to show cause why the appeal should not be dismissed. (Order at 1, citing 13 C.F.R. §§ 134.1305 and 134.1308.) On December 1, 2023, Appellant moved to withdraw its appeal.

*1 Appellant's withdrawal renders this appeal moot, as there is no longer any case or controversy for OHA to resolve. Accordingly, the appeal is DISMISSED. This is the final decision of the U.S. Small Business Administration. 13 C.F.R. § 134.1315.
