INITIAL DECISION
 
*1 The Small Business Administration, by Associate General Counsel Eric S. Benderson, has issued an Order to Show Cause demanding Respondent D.A. Miller Agency to show cause why an order should not issue terminating Respondent from the Section 8(a) program. The Order to Show Cause states that if Respondent fails to file an answer with the SBA's Office of Hearings and Appeals within 30 days after service of the Order to Show Cause, Respondent shall be deemed to have: (a) waived its right to appear; and (b) authorized me to find the facts as alleged in the Order to Show Cause and to enter an initial decision based on such facts.
*1 According to the Order to Show Cause and related Certificate of Service:
*1 1. Respondent is a participant in the SBA's Section 8(a) program.
*1 2. Respondent has been delinquent in submitting financial statements to the SBA since on or about June 30, 1987.
*1 3. On April 28, 1989, the SBA sent a copy of the Order to Show Cause, by certified mail, to Deborah A. Miller, the proprietor of Respondent, at the following address, which is Respondent's last known place of business and mailing address:

*1 La Jolla, California 92037
*1 Respondent has not replied to the Order to Show Cause.
*1 I accordingly find the allegations contained in the Order to Show Cause to be the fact and conclude that, pur-pursuant to 13 CFR 124.112(a)(6), there is good cause for the termination of Respondent from the Section 8(a) program.
 
ORDER
 
*1 (1) Respondent D.A. Miller Agency is terminated from the Minority Small Business Program.
*1 (2) This proceeding is terminated and this Decision shall be effective 30 days after service as the final Agency decision, except as provided in 13 CFR 134.32.
