SIZE APEAL OF: KAPSUUN GROUP, LLC, APPELLANT

*1 On September 8, 2017, the Small Business Administration (SBA) Office of Government Contracting, Area VI (Area Office) issued Size Determination No. 06-2017-056 finding Kapsuun Group, LLC (Appellant) is not an eligible small business under a $7.5 million size standard.

*1 On September 19, 2017, Appellant filed this appeal with the Office of Hearings and Appeals (OHA). On September 29, 2017, SBA moved to remand the size determination. SBA stated that it did not have the complete proposal and other necessary documents when it originally processed the size determination. Also on September 29, 2017, Emergent, Inc., the original protestor in this matter, filed its opposition to SBA's motion for remand.

*1 SBA clearly wishes to reconsider its decision, and is, in effect, confessing error. As a matter of judicial economy, then, it is appropriate to give SBA the opportunity to reconsider its decision. Size Appeal of A2Z Promo Zone, SBA No. SIZ-5365 (2012). Accordingly, SBA's motion is GRANTED, and the size determination is VACATED and REMANDED to the Area Office.
