NAICS APPEAL OF: COMPUTER SYSTEMS CENTER, INC., APPELLANT

*1 On January 30, 2014, the Department of the Navy, NAVSUP FLC NORFOLK, in Philadelphia, Pennsylvania (Navy), issued Request for Quotation No. N00189-14-Q-Z022 for Special Access Program Support Services. The Contracting Officer (CO) set the procurement totally aside for small business and designated it under North American Industry Classification System (NAICS) code 541690, Other Scientific and Technical Consulting Services, with a corresponding $14 million annual receipts size standard.

*1 On February 12, 2014, Computer Systems Center, Inc. (Appellant), filed the instant appeal with the Small Business Administration (SBA) Office of Hearings and Appeals (OHA). Appellant argued that the CO's NAICS code selection is incorrect and that NAICS code 541513, Computer Facilities Management Services, with a corresponding $25.5 million annual receipts size standard, is correct for this procurement.

*1 On March 18, 2014, the CO notified OHA that the solicitation was canceled. Amendment 0005 to the solicitation, issued on March 14, 2014, states that “This solicitation is cancelled in its entirety due to a change in the requirements.”

*1 Cancellation of a solicitation eliminates the need for a review and decision on the selection of a NAICS code. E.g., NAICS Appeal of LVW Electronics, SBA No. NAICS-5339 (2012). Accordingly, the instant appeal is moot and must be dismissed.
