§ 9.9. Disciplinary procedure; appeals
(a) Except as provided in section 2.3(c)1 of this act, the procedure to be followed in the revocation of a firm's license under section 8.8(g)2 of this act or the imposition of discipline under section 9.13 of this act and in appeals taken from disciplinary actions of the board shall be that prescribed under 2 Pa.C.S. Ch. 5 Subch. A (relating to practice and procedure of Commonwealth agencies) and Ch. 7 Subch. A (relating to judicial review of Commonwealth agency action), 1 Pa. Code Part II (relating to general rules of administrative practice and procedure) and applicable regulations promulgated by the board.
(b) The board shall require an individual whose certification has been suspended or revoked to return his certificate or to certify in such manner as the board directs that it was lost, stolen or destroyed. Failure to comply with the board's directions shall be a misdemeanor of the third degree.
(c) The board may assess against the respondent in a disciplinary action under this act, as part of the sanction, the costs of investigation underlying that disciplinary action.
