§ 6027.10. Construction of act
The terms and conditions of this act are to be liberally construed so as to best achieve and effectuate the goals and purposes of this act. Liability shall be based on proximate and efficient causation. This act preempts and eliminates all present liability standards, including, but not limited to, the concept of a person who, without participation in the management of property, holds indicia of ownership primarily to protect a security interest. Under all provisions herein, the burden of proof shall be upon the person seeking to have a lender, fiduciary or economic development agency held liable for a response action or damages.
