§ 9436. Dismissal from office by court
Upon the hearing of said rule, if it shall be made to appear to the satisfaction of said court that the said officer is in default for the non-payment of money due the Commonwealth, the said court shall forthwith make a decree dismissing him from the said office; and upon receiving a certified copy of said decree, the commissioners of the proper county shall immediately fill the vacancy thereby created, until the next general election, by the appointment of a suitable person, who shall give bond in such amount and with such sureties as shall be ordered and approved by the court of quarter sessions of the proper county: Provided, That if the sum so found due be paid at any time before such decree is made, it shall discharge the proceedings.
