§ 9435. Proceeding against treasurer by sureties or attorney general
Whenever any county treasurer within this Commonwealth shall fail to pay to the Commonwealth, on demand being made, the balance found to be due by him upon settlement of his account by the Auditor General and State Treasurer, a petition may be presented to the court of common pleas of the county wherein the said treasurer may reside, at the instance of the Attorney General, or one or more of the sureties of said county treasurer, praying for his dismissal from office, on account of said default. Upon the presentation of said petition, the said court shall enter a rule upon said county treasurer, to appear on the day certain to show cause why he should not be removed from said office, of which due notice shall be given to said county treasurer.
