§ 1312. Penalties; injunctive relief
(a) An individual who violates any provision of this act shall be guilty of a misdemeanor, as herein set forth, and upon conviction thereof shall be punished by a fine of not less than $500 nor more than $1,000 or by imprisonment for not less than 30 days nor more than 90 days, or by both such fine and imprisonment; and on each additional offense shall be subject to a fine of not less than $1,000 and imprisonment of not less than six months nor more than one year, at the discretion of the court.
(b) The board may, in the name of the people of the Commonwealth of Pennsylvania, through the Attorney General's Office, apply for injunctive relief in any court of competent jurisdiction to enjoin an individual from committing any act in violation of this act. Such injunction proceedings shall be in addition to, and not in lieu of, all penalties and other remedies in this act.
(c) In addition to any other civil remedy or criminal penalty provided for in this act, the board, by a vote of the majority of the maximum number of the authorized membership of the board as provided by this act or by a vote of the majority of the qualified and confirmed membership or a minimum of four members, whichever is greater, may levy a civil penalty of up to $1,000 on any current licensee or certificate holder who violates any provisions of this act or on an individual who practices physical therapy without being properly licensed to do so under this act or who practices as a physical therapist assistant without being properly certified to do so under this act.
(d) All fines and civil penalties imposed in accordance with this section shall be paid into the Professional Licensure Augmentation Account.
