§ 811. Damages ascertained
Any damages sustained by any property owner by reason of the said board carrying out the provisions of this act shall be paid by the Department of Forests and Waters,1 and the amount thereof, if not agreed upon between the property owners and the department, shall be ascertained on the petition of the department, or any person, copartnership, association, or corporation interested, in the manner provided by section five of the act, approved the second day of May, one thousand nine hundred and twenty-nine (Pamphlet Laws, one thousand five hundred thirty),2 entitled “An act relating to the erection of a dam at the outlet of Pymatuning Swamp, and the establishment of a reservoir for the flood control of the Shenango and Beaver Rivers; conferring and continuing certain powers and duties on the Department of Forests and Waters in relation to the establishment and maintenance of such reservoir; providing for the acquisition of necessary lands therefor, and the necessary agreements and releases relating thereto, and the disposition of surplus land and materials,” for ascertaining the amount of damages sustained by reason of the erection and maintenance of the dam and reservoir provided for in said act.
The amount of damages assessed against the Commonwealth in any such condemnation proceedings shall be paid, by the Department of Forests and Waters, out of any moneys appropriated for that purpose or received from the person or persons, or other agency, making the request for the work or works authorized under this act and heretofore appropriated.
