§ 1197. Hearing procedure and judicial review
(a) Any insurer, rating organization or person aggrieved by any action of the Commissioner, except disapproval of a filing or a part thereof as provided for in section five hereof,1 or by any rule or regulation adopted and promulgated by the Commissioner, shall have the right to file a complaint with the Commissioner and to have a hearing thereon before the Commissioner. Pending such hearing and the decision thereon the Commissioner may suspend or postpone the effective date of his previous action, rule or regulation.
(b) All such hearings and all hearings provided for in section five hereof shall be conducted, and the decision of the Commissioner on the issue or filing involved shall be rendered, in accordance with the provisions of the Administrative Agency Law approved the fourth day of June, one thousand nine hundred forty-five (Pamphlet Laws 1388),2 or any amendment thereof, relating to adjudication procedure.
(c) Any insurer, rating organization or person aggrieved by any adjudication, including a disapproval of a filing or portion thereof under the provisions of section five hereof, shall have a right to appeal therefrom.
