§ 2391.3-2. Highway and transit utilities; acquisition of rights-of-way
The Secretary of Transportation may, by condemnation or otherwise, acquire necessary rights-of-way in fee to accommodate the highway and transit utility, and may make such arrangements with the utility as to sharing of the cost of such acquisition as he shall deem advisable.
