The following words and phrases when used in this article shall have the meaning given to them in this section unless the context clearly indicates otherwise:

“Chief school administrator.” The superintendent of a public school district, superintendent of an area career and technical school, executive director of an intermediate unit or chief executive officer of a charter school.

“Commission.” The Pennsylvania Commission on Crime and Delinquency.

“Committee.” The School Safety and Security Committee established under section 1302-B.¹

“Department.” The Department of Education of the Commonwealth.

“Fund.” The School Safety and Security Fund established under section 1306-B(h).²

“Program.” The School Safety and Security Grant Program established under section 1306-B(a).

“School entity.” A school district, intermediate unit, area career and technical school, charter school, cyber charter school, regional charter school, approved private school, chartered school for the education of the deaf or the blind or private residential rehabilitative institution.

“School property.” As defined in section 1301-A.³

“School safety and security assessment.” A strategic evaluation of a school entity's facilities and programs used to identify potential safety and security threats.

“State-related institution of higher education.” As the term “State-related institution” is defined in section 1502-A.⁴

“Student with a disability.” A student who meets the definition of “child with a disability” under 20 U.S.C. Ch. 33 (relating to education of individuals with disabilities) or who meets the definition of a “handicapped person” under 29 U.S.C. § 794 (relating to nondiscrimination under Federal grants and programs) and its implementing regulations (34 CFR 104.3(j)). The term includes a student for whom an evaluation is pending under either 20 U.S.C. Ch. 33 or 29 U.S.C. Ch. 16 (relating to vocational rehabilitation and other rehabilitation services).

“Weapon.” The term shall include, but not be limited to, a knife, cutting instrument, cutting tool, nunchaku, firearm, shotgun, rifle and other tool, instrument or implement capable of inflicting serious bodily injury.
