OKLAHOMA DEPARTMENT OF COMMERCE
An Act relating to the Oklahoma Department of Commerce; requiring that portions of certain funds be utilized for certain purposes; providing budgeting and expenditure limitations and procedures; and providing for lapse of funds under certain conditions.
SUBJECT: Oklahoma Department of Commerce
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Three Hundred Thousand Dollars ($300,000.00) shall, under the direction of the Executive Director of Commerce, be allocated to the Automotive Accelerator Program within the Department. Such funds shall be used to attract original equipment manufacturing and parts supply companies.
SECTION 2. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Three Hundred Fifty Thousand Dollars ($350,000.00) shall, under the direction of the Executive Director of Commerce, be allocated to the Rogers State University TV's Distance Learning Classroom.
SECTION 3. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of One Hundred Eighty-eight Thousand One Hundred Eighty-seven Dollars ($188,187.00) shall, under the direction of the Executive Director of Commerce, be used for the Community Expansion of Nutrition Assistance Program.
SECTION 4. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Sixty Thousand Dollars ($60,000.00) shall, under the direction of the Executive Director of Commerce, be allocated to support substate planning districts.
SECTION 5. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Five Hundred Three Thousand Two Hundred Fifty-eight Dollars ($503,258.00) shall, under the direction of the Executive Director of Commerce, be allocated to Seminole State College's Rural Business and Resources Center.
SECTION 6. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of One Hundred Thousand Dollars ($100,000.00) shall, under the direction of the Executive Director of Commerce, be allocated to the Department's Aerospace Commerce Economic Services (ACES) Program. Such funds shall be used for maintaining the program.
SECTION 7. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Seven Hundred Twelve Thousand Two Hundred Seventy-nine Dollars ($712,279.00) shall, under the direction of the Executive Director of Commerce, be allocated to the Oklahoma Film and Music Office within the Department. Such funds shall be used for operational maintenance of the Office given its transfer to the Department during the previous fiscal year.
SECTION 8. From the funds appropriated to the Oklahoma Department of Commerce in Enrolled Senate Bill No. 1040 of the 2nd Session of the 58th Oklahoma Legislature, the sum of Four Hundred Thirty-seven Thousand Nine Hundred Nineteen Dollars ($437,919.00) shall, under the direction of the Executive Director of Commerce, be allocated to the Department's Community Development program for the purpose of supporting community action agencies.
SECTION 9. Appropriations made by this act, not including appropriations made for capital outlay purposes, may be budgeted for the fiscal year ending June 30, 2023 (hereafter FY–23) or may be budgeted for the fiscal year ending June 30, 2024 (hereafter FY–24). Funds budgeted for FY–23 may be encumbered only through June 30, 2023, and must be expended by November 15, 2023. Any funds remaining after November 15, 2023, and not budgeted for FY–24, shall lapse to the credit of the proper fund for the then current fiscal year. Funds budgeted for FY–24 may be encumbered only through June 30, 2024. Any funds remaining after November 15, 2024, shall lapse to the credit of the proper fund for the then current fiscal year. These appropriations may not be budgeted in both fiscal years simultaneously. Funds budgeted in FY–23, and not required to pay obligations for that fiscal year, may be budgeted for FY–24, after the agency to which the funds have been appropriated has prepared and submitted a budget work program revision removing these funds from the FY–23 budget work program and after such revision has been approved by the Office of Management and Enterprise Services.
