MOTOR VEHICLES
An Act relating to motor vehicles; providing for weight exemption for certain vehicles; extending weight exemption to certain roads; providing for codification; and declaring an emergency.
SUBJECT: Motor vehicles
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
SECTION 1. NEW LAW A new section of law to be codified in the Oklahoma Statutes as Section 14–109.4 of Title 47, unless there is created a duplication in numbering, reads as follows:

A. A motor vehicle or a commercial motor vehicle, if operated by an engine fueled wholly or partially by an electric battery or hydrogen fuel cell electric fueling system, may exceed the gross vehicle weight limits and any axle weight limits by an amount, not to exceed a maximum of two thousand (2,000) pounds, that is equal to the difference between:
1. The weight of the vehicle attributable to electric batteries or hydrogen fuel cell electric fueling system carried by that vehicle; and
2. The weight of a comparable diesel tank and fueling system.
B. The weight exemption allowed under this section shall extend to all state roads and highways; however, vehicles operating pursuant to the provisions of this section shall only be allowed to operate on the National System of Interstate and Defense Highways with a federal exemption.
SECTION 2. It being immediately necessary for the preservation of the public peace, health or safety, an emergency is hereby declared to exist, by reason whereof this act shall take effect and be in full force from and after its passage and approval.
