Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. Division of Criminal Justice Services Promulgation Certification
I, Michael C. Green, Executive Deputy Commissioner of the Division of Criminal Justice Services (Division), do hereby amend existing section 6050.1(a), (b) and (c) of Title 9 of the Official Compilation of Codes, Rules and Regulations and do certify that the attached text of such amendments is complete and accurate. Accordingly, I hereby promulgate the following regulations which have been recommended by the Division’s identification and intelligence unit.
NOW, THEREFORE, be it known that the following rules and regulations, which are exempt from the provisions of the State Administrative Procedure Act pursuant to State Administrative Procedure Act section 102(1), are duly adopted pursuant to the authority vested in me by Executive Law section 837(13) and shall be effective upon publication in the State Register.
Section 1. The following section 6050.1(a), (b) and (c) of Title 9 of the New York State Official Compilation of Codes, Rules and Regulations is hereby amended and adopted.

Section 6050.1 Individual's right to review own record.
(a) A person, or a person's attorney who has been duly authorized in writing, upon satisfactory fingerprint identification, or other alternative method of positive identification deemed satisfactory by the Commissioner of the Division of Criminal Justice Services (commissioner), and payment of the required fee, may obtain a copy of the complete criminal history record information maintained by the Division of Criminal Justice Services (DCJS) pertaining to such person, or a response indicating that there are no such records on file[, and may challenge the completeness or accuracy of such information]. Such person may also request, and DCJS may provide, a copy of such person’s redacted criminal history record information which does not include information which has been sealed or suppressed pursuant to the Criminal Procedure Law or suppressed or destroyed pursuant to the Family Court Act. The completeness or accuracy of the criminal history may be challenged pursuant to 9 NYCRR Part 6050.2. Such criminal history record information shall be transmitted only to the address indicated on the request form. If a person is detained or incarcerated in a local or State correctional facility, the criminal history record information supplied shall not contain identifying data. A person detained or incarcerated in a local or State correctional facility may request up to four copies per calendar year of criminal history record information maintained by the division pertaining to such inmate. If an inmate’s criminal history changes after he or she has requested and received four copies in a calendar year, such inmate may request and receive an additional copy.
(b) Payment for such information shall be made [by postal money order, Western Union, Integrated Payment System, Traveler's Express, or bank money order, made payable to the "New York State Division of Criminal Justice Services." Bank money orders must be issued by an American bank, must be payable in U.S. funds and must be valid for at least 90 days from the date of issuance. Remittance, together with a completed fingerprint card and the completed request form shall be directed to DCJS, Record Review Unit, 4 Tower Place, Albany, NY 12203.] in a form and manner prescribed by DCJS. [If a person is incarcerated in a local or State correctional facility, payment shall be made in a manner approved by the commissioner.] The fee for a copy of either the complete or redacted criminal history record information shall be $50. Upon satisfactory proof of financial hardship, however, the commissioner, or his/her designee, may waive all, or a portion, of the fee. Factors to be considered when determining financial hardship may include indigence, available assets, eligibility for, and receipt of, State or Federal aid which is based on income or disability, or unreasonable hardship caused by the payment of such fee. The commissioner, or his or her designee, may require a certain form of payment from an individual or entity if, on prior requests, payment has been uncollectible.
(c) Record review responses do not replace or supplant any statutory or other legal requirements imposed by law or regulation regarding or requiring fingerprint submissions for employment, license, permit or other applications pursuant to Federal, State or local laws.

Susquehanna River Basin Commission Commission Meeting: Correction
SUMMARY: The Susquehanna River Basin Commission published a document in the Federal Register of November 10, 2014, concerning its regular business meeting on December 5, 2014, in Annapolis, Maryland. The location of the meeting has been changed and the new location is contained in the Addresses section of this notice. Also an agenda item has been added to be addressed at the business meeting and is contained in the Supplementary Information section of this notice.
