PURSUANT TO THE PROVISIONS OF THE State Administrative Procedure Act, NOTICE is hereby given of the following action:
Action taken:
Amendment of Part 142 of Title 1 NYCRR.
Statutory authority:
Agriculture and Markets Law, sections 18, 164 and 167
Subject:
Spotted Lanternfly (“SL”).
Purpose:
To prevent SL-infested articles originating in specific counties in NJ, PA, MD, VA, WV and DE from entering NYS.

Initial Review of Rule
As a rule that requires a RFA, RAFA or JIS, this rule will be initially reviewed in the calendar year 2023, which is no later than the 3rd year after the year in which this rule is being adopted.
Assessment of Public Comment
The Department of Agriculture and Markets received one (1) emailed comment. The Department received a comment from a trade industry group that suggested that the Department adopt a NYS based certificate of inspection. No change was made as a result of this comment as NYS and the other states involved in this rule, through their involvement with the Eastern Plant Board and the National Plant Board, have agreed to reciprocity on Spotted Lanternfly Certificates.
