The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2009-0542, Nassau County Department of Public Works (DPW) has applied for authorization from the New York District of the United States Army Corps of Engineers to perform several activities within Udalls Mill Pond, Village of Saddle Rock, Town of North Hempstead, Nassau County. The activities are proposed to take place adjacent to the New York State and federally designated Significant Coastal Fish and Wildlife Habitat known as Little Neck Bay and include the following:
•Proposed dredging of the southeast corner of the pond to excavate a stream area ~40-foot wide by 3.5-foot deep; dredged material proposed to be used to be re-used to create wetland and bank areas along the southeast bank adjacent to the library; invasive plant species are proposed to be removed, and proposed dredging of an area on the eastern side of the bridge to create a “sediment trap.” Dredging of the eastern portion of the pond will result in ~23,000 cubic yards (cy) of material.
•Proposed dredging of an area on the western side of the bridge to remove ~20,000 cy of accumulated organic sediments. This material will be de-watered on adjacent County owned land with return flow back into the pond. The material will then be transported off-site and placed in an approved NYSDEC upland location.
•Proposed repair of the existing and dilapidated weir located at the far western end of the pond to return the pond elevation to 3.6-foot (NGVD 88).
•Proposed construction of a fixed elevated boardwalk along the southwest bank of the stream section adjacent to the library area.
The applicants have stated that “Water quality is poor with high bacteria counts and excessive nutrients. Much of the sediment is contaminated with high levels of metals.” The stated purpose of the proposed activities is to “improve water quality, drainage, circulation, and the general ecology of the pond.”
Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, December 17, 2009.

In F-2009-0674, the Brewers Yacht Yard at Mystic, located in Mystic, Connecticut, is seeking approval from the New England District Army Corps of Engineers to perform activities associated with the expansion of an existing marina facility, including the dredging of ~14,000 cubic yards (cy) of material with a 1-foot overdredge depth, resulting in and additional ~3,000 cy of material. The dredge material, approximately 17,000 cy in total, is proposed to be disposed of at the New London Disposal Site (NLDS) located within Long Island Sound. The NLDS is a 1 nautical mile square open-water site located ~1.5 miles east of Fishers Island, Town of Southold, County of Suffolk, New York.
The proposed open-water disposal of dredged material at the NLDS would be undertaken in an area covered by the State and federally approved Long Island Sound Coastal Management Program (LIS CMP), which contains the enforceable policies of the New York Coastal Management Program for this region, and is therefore subject to consistency review with the policies and purposes of the LISCMP.
Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, December 17, 2009.

The applicant is also seeking approval from the New England District Army Corps for open-water disposal of the 7,000 cy of dredged material at either the Western Long Island Sound (WLIS) or Central Long Island Sound (CLIS) open-water disposal sites.
The proposed maintenance dredging would be undertaken in an area covered by the State and federally approved City of Rye Local Waterfront Revitalization Program (LWRP), which contains the enforceable policies of the New York Coastal Management Program for this region, and is therefore subject to consistency review with the policies and purposes of the City of Rye LWRP. The proposed dredging will also take place within the State and federally designated Significant Coastal Fish and Wildlife Habitat named "Marshlands Conservancy."
The proposed open-water disposal of dredged material at either the WLIS or CLIS would be undertaken in an area covered by the State and federally approved Long Island Sound Coastal Management Program (LIS CMP), which contains the enforceable policies of the New York Coastal Management Program for this region, and is therefore subject to consistency review with the policies and purposes of the LISCMP.

Department of Taxation and Finance Interest Rates
The Commissioner of Taxation and Finance hereby sets the interest rates for the months of January, February, and March, 2010 pursuant to sections 697(j) and 1096(e) of the Tax Law, as follows:
For purposes of section 697(j) the overpayment rate of interest is set at 3 percent per annum, and the underpayment rate of interest is set at 7-1/2 percent per annum. For purposes of section 1096(e), the overpayment rate of interest is set at 3 percent per annum, and the underpayment rate of interest is set at 8 percent per annum. (The underpayment rates set pursuant to sections 697(j) and 1096(e) may not be less than 7-1/2 percent per annum.) Pursuant to section 1145(a)(1) of the Tax Law, the underpayment rate for State and local sales and use taxes administered by the Commissioner of Taxation and Finance is 14-1/2 percent per annum. The underpayment rate for the special assessments on hazardous waste imposed by section 27-0923 of the Environmental Conservation Law is 15 percent.

However, where the Commissioner determines that the failure to pay or delay in payment is due to reasonable cause and not willful neglect, the Commissioner may impose interest at the corporation tax late payment and assessment rate.
