Department of State F-2009-0645 (DA) Date of Issuance -September 9, 2009
The New York State Department of State (DOS) is required by Federal law to provide timely public notice for the activity described below, which is subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The United States Department of the Navy, has determined that the proposed activity complies with and will be conducted in a manner consistent to the maximum extent practicable with the approved New York State Coastal Management Program. The consistency determination and accompanying public information and data is available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2009-0645 (DA), the U.S. Department of the Navy (Navy) is proposing to perform waterfront maintenance dredging at the Naval Submarine Base New London (SUBASE). Thames River, Groton, Connecticut.
The proposed waterfront maintenance dredging project will consist of two separate dredging and disposal activities and are described below:
•The excavation of approximately 170,000 cubic yards (cy) of material from around several piers and a drydock berth at the SUBASE. This material is proposed to be disposed of within a Confined Aquatic Disposal (CAD) Cell created within the federal navigation channel in the Thames River, Groton, Connecticut.
•The creation of the CAD Cell within the federal navigation channel in the Thames River will involve the excavation of approximately 248,000cy of sediments from the footprint of the CAD cell. Approximately 18,000 cy of this material will be set aside for capping of the SUBASE material with the remaining 230,000 cy proposed to be placed at the New London Disposal Site (NLDS) in Long Island Sound., The NLDS is located approximately 1.5 miles west of Fishers Island, Town of Southold, Suffolk County, New York.
The stated purpose for the proposal is to allow for the continued use of the SUBASE piers and the drydock berth, which are essential to the SUBASE mission.
Any interested parties and/or agencies desiring to express their views concerning the above proposed activity may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or September 24, 2009.

Involved is the erection of a storage structure at a fire separation distance that does not meet the requirements for its construction type, located at 5300 Frontier Avenue, City of Niagara Falls, County of Niagara, State of New York.

Involved is new construction of R-2 (residential, 8 apartment units) occupancies each of type VB-unprotected frame construction, two story in height and approximately 6,272 square feet in gross floor area. They will be located at 30 Big Tree Street which is located on the south side of New York State Highway Route 20-A approximately 50 feet west of the intersection with Lake Glenn Drive, Village of Livonia, County of Livingston, State of New York.
