Notice of Abandoned Property Received by the State Comptroller
Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. A list of the names and last known addresses of the entitled owners of this abandoned property is maintained by the office in accordance with Section 1401 of the Abandoned Property Law. NOTICE OF PUBLIC HEARING
Office of Mental Retardation and Developmental Disabilities
Pursuant to Mental Hygiene Law Section 41.36, The NYS Office of Mental Retardation and Developmental Disabilities (OMRDD) will hold public hearings on proposed regulations (MRD-03-09-000004) to amend 14 NYCRR Sections 81.10, 635-10.5, 671.7, 680.12, 681.14 AND 690.7. The proposed regulations establish a trend factor of zero percent for the rate/fee periods beginning January 1, 2009 and July 1, 2009 for the following facilities and services: programs authorized by OMRDD to operate as Integrated Residential Communities (amendments to section 81.10); Individualized Residential Alternative (IRA) facilities and Home and Community-based (HCBS) Waiver services (amendments to section 635-10.5); Home and Community-based (HCBS) Waiver Community Residential Habilitation Services (amendments to section 671.7); Specialty Hospitals (amendments to section 680.12); Intermediate Care Facilities for Persons with Developmental Disabilities (ICF/DD) (amendments to section 681.14); and Day treatment facilities serving people with developmental disabilities (amendments to section 690.7).
The public hearings originally scheduled in association with the proposed rule making were postponed and have been have been rescheduled as follows:

Notice is hereby given that the Office of Children and Family Services has determined that the Auburn Residential Center, situated at 6734-6736 Pine Ridge Road, Town of Sennett, Cayuga County, improved with a one story institutional building consisting of 12,780± square feet, plus four out buildings, circa 1960's, located on approximately 9.911 acres, is no longer useful or necessary for their purposes and has declared the same abandoned to the Office of General Services for sale or other disposition as Unappropriated State land.

PUBLIC NOTICE
Power Authority of the State of New York
The Power Authority of the State of New York (Authority) is soliciting proposals from qualified administrative service agencies and/or financial organizations relating to trust service and/or administration of a deferred compensation plan for employees of the Authority meeting the requirements of Section 457 of the Internal Revenue Code and Section 5 of the New York State Finance Law, including all rules and regulations issued pursuant thereto. Additionally, the Authority is soliciting therewith proposals from qualified service agencies and/or financial organizations for administrative/recordkeeping services, investment services and Trustee services for its Employees' Savings Plan (401k).

Department of State F-2009-0234 Date of Issuance - July 15, 2009
The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2009-0234, the Central Hudson Gas & Electric Corporation (CHGE) is seeking approval from the U.S. Army Corps of Engineers, New York District, for the remediation of contaminated sediments at the former CHGE site in and along the Hudson River, located on South Water Street, City of Newburgh, Orange County.
The proposed remediation activities are being undertaken in response to a NYSDEC Order on Consent (Index# D3-0001-95-06) as part of the December 2005 Record of Decision for the site (Site #3-36-042), issued by the NYSDEC and the U.S. Environmental Protection Agency (USEPA) for the containment and removal of non-aqueous phase liquid (NAPL) coal tar from the upland portion of the project (area B), and the removal of ~26,000 cy of NAPL and polycyclic aromatic hydrocarbon (PAH) impacted sediments from within the river (area C). Area A, as identified in Site #3-36-042, was previously completed between November 2006 to August 2007. The dredged sediments will be processed and transported off-site for treatment and disposal. All disturbed areas will be restored using clean fill, re-graded and replanted. Some of the specifics of the project include:
At Area B
•Installation of a steel sheeting barrier wall and construction of a gravel filled collection trench along the bank of the Hudson River to contain and collect NAPL coal tar. The barrier wall will be installed at elevation 2.5 feet above mean sea level, which equates to the mean high water (MHW) level of the Hudson River at the site location. The collection trench will drain into a series of sumps to allow for periodic collection and removal of the NAPL.
•Construction of a temporary stone access road, temporary material and equipment staging areas, sediment handling area, an equipment decontamination area, and temporary removal of rip-rap along the shoreline to facilitate barrier wall installation and sediment removal activities.
At Area C
•Removal of debris and sunken barge located at the site, prior to dredging.
•Installation of a steel sheeting cofferdam to isolate the NAPL impacted sediment removal area and to provide turbidity control.
•Employment of turbidity curtains placed around the exterior perimeter of the cofferdam.
•Installation of A king-pile system for excavation support in areas of deep dredging/removal.
•Dredging of the NAPL impacted sediments performed in the wet using mechanical dredging equipment.
•Amendment of sediments, as necessary, on-site with subsequent transport off-site for treatment and disposal.
•Dredging of PAH impacted sediments from a one (1) acre area outside of the cofferdam, processed as appropriate and transported off-site for treatment and disposal.
•Employment of turbidity curtains to contain resuspension of PAHs.
At Areas B & C
•Site Restoration activities will include: placing select fill materials within excavated bank areas to restore the ground surface; backfilling the dredged areas to approximate pre-remediation grades; restoring the existing rip-rap-lined shoreline area; revegetating disturbed areas within the site; restoring surface features that may be disturbed or damaged; and decontamination of equipment.
The applicant has certified that Best Management Practices (BMP) and Engineering Controls will be used at all phases of the project. An Erosion and Sediment Control Plan has been developed, and a temporary water treatment system will be constructed to control any waste streams generated during remediation activities. Surface water monitoring, turbidity monitoring and air quality monitoring will be conducted to ensure proper containment of contaminants.
Any interested parties and/or agencies desiring to express their views concerning the above proposed activities may do so by filing their comments, in writing, no later than 4:30 p.m., 15 days from the date of publication of this notice, or, July 30, 2009.
