REVISED Banking Department
New York State's Banking Development District Program
The New York State Banking Department ("NYSBD") is in the process of reviewing its Banking Development District ("BDD") program, which was created by the New York State Legislature in 1999 to encourage the establishment of bank branches in areas with a demonstrated need for banking services. BDD bank branches can help provide the services necessary to stimulate local economies by enhancing access to capital for local businesses, promoting long-term economic development, fostering job creation and promoting community stabilization and revitalization.
The first phase of the assessment included surveying participating banks and the communities they served, and the second phase is a series of four public hearings to provide the NYSBD with additional insight on the effectiveness of the BDD program and to hear ideas on how the program might be improved.
Hearings are scheduled from 1:00 p.m. to 4:00 p.m. on the following days:
• Thursday, April 2, 2009 at the Adam Clayton Powell Building1
• Monday, April 6, 2009 in Syracuse at the Oncenter Complex Center2
• Wednesday, April 8, 2009 in Saratoga at the Saratoga County Arts Council3
• Monday, April 13, 2009 in Buffalo at the True Bethel Baptist Church4
The NYSBD seeks testimony on questions including, but not limited to:
• Should a newly proposed BDD be allowed to overlap geographically with a currently existing BDD?
• Should a bank purchasing a BDD branch be entitled to assume the BDD program benefits enjoyed by the previous bank owner?
• Should the initial subsidy of two years be extended?
• Should there be a limit on the number of times a BDD branch may seek to renew BDD deposits?
• Should banks already located in a BDD area receive below market rate deposits, and if so, under what circumstances and pursuant to what standards?
• Should there be a financial literacy component required for BDD branches?
• Should the BDD program be extended to credit unions, and if so, pursuant to what standards?
• Are BDDs meeting the financial needs of the underbanked and unbanked residents within the District?
• From the bank and community perspective, what are the benefits of having a BDD in the community?
The NYSBD also seeks suggestions on the following:
• How to improve the BDD program.
• How to expand bank participation in the BDD program.
• Ways to better meet the needs of the unbanked and underbanked.
The NYSBD will receive testimony during the hearing and will issue aggregated findings after all of the hearings have been conducted.

Oral testimony will be limited to eight (8) minutes in duration. Persons testifying must submit an electronic copy of their written testimony to the NYSBD by the following dates:
• New York City hearing by March 25, 2009;
• Syracuse and Saratoga hearings by April 1, 2009, and;
• Buffalo hearing by April 7, 2009.
Persons testifying also must bring five copies of their testimony with them on the day of the hearing.

Department of Health
Pursuant to 42 CFR § 447.205, the Department of Health hereby gives public notice of the following:
The Department of Health (“the Department”) proposes to amend the Title XIX Medicaid State Plan for transportation services to clarify the state fiscal year 2008/09 statewide aggregate amount that will be expended for emergency medical transportation service supplemental medical assistance payments to ambulance providers.
On April 30, 2008, the Department provided public notice that the statutorily established aggregate amount of such payments for SFY 08/09 would be $6.0 million.
On September 24, 2008, pursuant to further legislative action, the Department provided public notice that the statutorily established aggregate amount of such payments for SFY 08/09 would instead be $5,640,000.
The Department is now providing public notice that, as a result of legislative action subsequent to September 24, 2008, the statutorily established aggregate amount of such payments for SFY 08/09 will instead be $4,512,000.
For each ambulance provider that receives medical assistance payments, the Department shall determine the ratio of such provider’s State-processed reimbursements to the total of such reimbursements made during each quarter of the calendar year, expressed as a percentage. The Department shall multiply the percentage of medical assistance reimbursements made to each ambulance provider by the aggregate amount. The result of such calculation shall represent the “emergency medical transportation service supplemental payment”.
The amount to be disbursed to providers whose area of operation is within the City of New York will be twenty-five percent of the applicable aggregate amount, with the remaining seventy-five percent to be disbursed to all other ambulance providers.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2009-0001, the New York City Department of Environmental Protection is seeking approval from the U.S. Army Corps of Engineers (COE) for the dredging and removal of approximately 15,200 cubic yards of contaminated sediments deposited from combined sewer overflows (CSOs) within the head end of Paerdegat Basin. Once the sediments have been removed, the applicants propose to place approximately one (1) foot of clean sand cap. The contaminated sediments are proposed to be disposed of at an approved upland location, in accordance with all applicable requirements. The applicants have also proposed to dredge approximately 5,500 cubic yards of clean material from the inlet channel to the basin to improve public access. The clean dredged material is proposed to be used for beneficial re-use projects in the surrounding area. The proposed activity is to be undertaken in the Paerdegat Basin, Brooklyn, Kings County.
The stated purpose of the proposal is to remove sediments deposited from CSOs within the head end of the basin. These sediments have resulted in the generation of intermittent nuisance odors due to hydrogen sulfide emissions from decaying matter in CSO sediment. The inlet to the basin will be dredged as a result of requests from stakeholders to restore boat navigation within the basin.

In F-2009-0059, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) is seeking approval from the National Parks Service (NPS) under the Federal Land and Water Conservation Fund (LWCF) for the conversion of a parcel of land situated at Jones Beach State Park totaling 128,704 square feet for the construction of the Jones Beach Restaurant and Catering Facility and appurtenances (“Trump on the Ocean”). The substitution parcel is a 72 acre parcel situated in the Hamlet of Ridge, Town of Brookhaven, Suffolk County.
The stated purpose of the proposal is to replace the previous Boardwalk Restaurant that was partially demolished in 2004, and that had replaced the Boardwalk Restaurant originally constructed in the 1930s.

• the proposed installation of a ±228ft x 8ft main float with eighteen 20ft x 3ft finger floats, a ±216ft x 8ft main float with thirteen 20ft x 3ft finger floats, two 20ft x 4ft finger floats, two 13ft x 42 and one 19ft x 42ft sail floats, all with associated ramps, restraint piles and tie-off piles.
• the proposed reconstruction and/or replacement of an existing 12ft x 20ft floating dinghy dock waterward of the apparent high water line.
• the proposed installation of a small boat crane landward of the apparent mean high water line.
The stated purpose of the proposal is to maintain accessibility to the existing boat dock basin for recreational boating.
