Pursuant to provisions of the Abandoned Property Law and related laws, the Office of the State Comptroller receives unclaimed monies and other property deemed abandoned. Department of Health
The New York State Department of Health (DOH) is required by the provisions of the federal Beaches Environmental Assessment and Coastal Health (BEACH) Act to provide for public review and comment on the Department's beach monitoring and notification plan. The BEACH Act (Section 406(b) of the Clean Water Act) enacted a federal Environmental Protection Agency grant program available to states, such as New York, with coastal recreational waters. Coastal recreational waters include the Great Lakes and marine coastal waters that are designated for swimming, bathing, surfing, or similar water contact activities. The Act is not applicable to inland waters or waters upstream of the mouth of a river or stream having an unimpaired natural connection with the open sea.
The beach monitoring and public notification also includes information on the beach evaluation and classification process, including a list of waters to be monitored and beach ranking. Also included in this plan, is the sampling design and monitoring plan, including sampling location and sampling frequency. Lastly the plan contains information on procedures for public notification and risk communication, including methods to notify the public of a swimming advisory or beach closure.

Department of Health
The New York State Department of Health hereby gives notice of its intent to award funding in the amount of $36,000 ($12,000 per organization) to the following Community Based Organizations (CBOs): AIDS Community Resources, AIDS Council of Northeastern New York and AIDS Rochester. Grant funds will be utilized for syphilis elimination activities. The contracts will support implementation for expanded bath house testing and screening related to syphilis elimination, focusing on the integration of syphilis screening into bath houses already providing HIV screening. In addition the CBOs will also include related outreach STD screening to risk populations in surrounding geographic areas, including outreach venues reaching Men having Sex with Men (MSM).

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at One Commerce Plaza, 99 Washington Avenue in Albany, New York.
In F-2008-0970, New York City Economic Development Corporation is planning “shoreline improvements” along a nearly two-mile long City-owned public space which would connect the shoreline area along the East River from the Battery Maritime Building at 10 South Street to the East River Park to the north in Lower Manhattan, New York County, New York. The goals of the Project are to: increase public access to the waterfront; activate the waterfront year round by providing new cultural, community, commercial and recreation nodes along its entire length; and complete the Manhattan Greenway around lower Manhattan and provide safe and attractive pedestrian walkways and bicycle pathways.
The proposed activity includes the following components:
• Esplanade A
The current design concept is for the construction of an 1100-foot long walkway and bicycle pathway immediately adjacent to the existing seawall. The esplanade would protrude over the water a maximum of 16"2' resulting in approximately 11,420 square feet of overwater coverage.
• Pier 15
The applicant is proposing the reconstruction of Pier 15 as a pile supported structure on an overall 20' grid, with a reinforced concrete deck, and a second level deck. The Pier will have an overall footprint of approximately 514' x 80'. The lower level of the pier will have a deck area of approximately 30,865 square feet, or 38,750 square feet including the reconstruction of the apron areas. The upper level will have a deck area of approximately 20,100 square feet.
Portions of Pier 15 have been designed to meet three intended programmatic goals. The first is space along the north and south edges of the pier dedicated to the docking of historic ships (north edge) and commercial ships (south edge). Second, is an approximately 2,250 square foot maritime education center which will also include 1,575 square feet of café space on the lower portion of the pier. Third is public access on both levels of the pier.
• Pier 35
NYCEDC is proposing to develop Pier 35 as an educational center and food destination to build public awareness on the issue of sustainable seafood and fisheries depletion. The Pier 35 design includes space for the uses described below:
• Building for restaurant/education 3,500 square feet
• Lower level lawn and paved areas 15,850 square feet
• Ecopark 2,050 square feet
• Upper level, including ramps to upper level 7,900 square feet
• Stairs at the east end 1,500 square feet
• Lawns and paved areas are for passive recreational uses.
The proposed 3,500 square foot building on Pier 35 would function as a “Bluemarket”—a source for information on sustainable seafood and products from sustainable fisheries to build public awareness of the aquatic resources of the State of New York and the consequences of personal seafood selection. The building would include a restaurant that would focus on both locally-sourced seafood and seafood from sustainable fisheries worldwide.
Pier 35 is in sound condition and will require no significant below-deck work. It is proposed that a two-story structure will be placed atop the existing deck; a small, approximately 2,100 square foot cut-out will be made in the deck and replaced with a planted area; and possible modifications of the pile-to-deck connections be made to provide seismic resistance. On the north edge of the pier, a green screen wall will be constructed to obscure the adjacent sanitation building.
• “Step-Downs”/“Look Outs”
Three ADA accessible “look out” structures are proposed with associated bulkhead reconstruction to facilitate visual access to the water. These structures would be located at the edge of Wall Street, Pike Slip and Rutgers Slip.

Department of Taxation and Finance Interest Rates
Pursuant to the provisions of subsection (j) of section 697 of the Tax Law, the Commissioner of Taxation and Finance hereby sets the overpayment rate of interest for the purposes of said subsection for the months of April, May, and June 2009, at 3 percent per annum; and sets the underpayment rate of interest for the purposes of said subsection for the months of April, May, and June 2009, at 6 percent per annum. These rates are applicable to the New York State personal income tax (Article 22 of the Tax Law - except for rates of interest payable by or to an employer with respect to income taxes required to be withheld and paid over by the employer pursuant to Part V of such Article 22), unincorporated business income tax (Article 23 of the Tax Law), estate tax (Article 26 of the Tax Law), generation-skipping transfer tax (Article 26-B of the Tax Law), the New York City resident income tax (Article 30 of the Tax Law, Chapter 17 of the New York City Administrative Code), the New York City nonresident earnings tax (Article 2-E of the General City Law, Chapter 19 of the New York City Administrative Code), the City of Yonkers resident income tax surcharge (Article 30-A of the Tax Law, Article IX of the Codes and Ordinances of the City of Yonkers) and the City of Yonkers nonresident earnings tax (Article 30-B of the Tax Law, Article X of the Codes and Ordinances of the City of Yonkers).

These rates are applicable to the New York State corporation tax (Article 9 of the Tax Law), franchise tax on business corporations (Article 9-A of the Tax Law), franchise tax on state banks, trust companies, financial corporations and tax on savings and loan associations (Article 9-B of the Tax Law), tax on national banking associations and production credit associations (Article 9-C of the Tax Law), motor fuel and diesel motor fuel taxes (Article 12-A of the Tax Law), unrelated business income tax (Article 13 of the Tax Law), petroleum businesses tax (Article 13-A of the Tax Law), taxes on alcoholic beverages (Article 18 of the Tax Law), taxes on boxing and wrestling exhibitions (Article 19 of the Tax Law), tax on cigarettes and tobacco products (Article 20 of the Tax Law), highway use tax (Article 21 of the Tax Law), interest payable by or to an employer with respect to income taxes required to be withheld and paid over by the employer pursuant to Part V of Article 22 of the Tax Law, State and local sales and use taxes administered by the Commissioner of Taxation and Finance (Articles 28 and 29 of the Tax Law), special tax on passenger car rentals (Article 28-A of the Tax Law), real estate transfer tax (Article 31 of the Tax Law), franchise tax on banking corporations (Article 32 of the Tax Law), franchise taxes on insurance corporations (Article 33 of the Tax Law), tax on independently procured insurance (Article 33-A of the Tax Law), the special assessments on hazardous waste (section 27-0923 of the Environmental Conservation Law), waste tire management and recycling fee (section 27-1913 of the Environmental Conservation Law), and underpayments or overpayments of the mortgage recording tax (Article 11 of the Tax Law) in cities having a population of one million or more.
No underpayment rate set hereby shall be less than 6 percent per annum. The underpayment rate for State and local sales and use taxes administered by the Commissioner of Taxation and Finance shall not be less than 14 percent per annum. The underpayment rate for the special assessments on hazardous waste imposed by section 27-0923 of the Environmental Conservation Law shall be 15 percent.
