PUBLIC NOTICE
Department of State Routine Program Change Notice
STATEWIDE — Pursuant to 15 CFR 923.84(b)(4), the New York State Department of State (DOS) hereby gives notice that the Federal Office of Ocean and Coastal Resource Management (OCRM) concurred on November 2, 2007 on the incorporation of the Town of Somerset Local Waterfront Revitalization Program (LWRP) into the State's Coastal Management Program (CMP) as a Routine Program Change. DOS requested OCRM's concurrence on this action in a letter dated June 28, 2007, and in a previous notice in the New York State Register which further described the content of the action.
The Town of Somerset LWRP includes the following new or revised enforceable policies as found in the Town of Somerset LWRP: Policy1 and Policy Standards 1.1 — 1.5; Policy 2 and Policy Standards 2.1 — 2.4; Policy 3 and Policy Standards 3.1 — 3.2; Policy 4 and Policy Standards 4.1 — 4.4; Policy 5 and Policy Standards 5.1 — 5.5; Policy 6 and Policy Standards 6.1 — 6.3; Policy 7 and Policy Standards 7.1 — 7.4; Policy 8 and Policy Standards 8.1 — 8.6; Policy 9 and Policy Standards 9.1 — 9.4; Policy 10 and Policy Standards 10.1 — 10.4; Policy 11 and Policy Standard 11.1; Policy 12 and Policy Standards 12.1 — 12.4; and Policy 13 and Policy Standards 13.1 — 13.5, (with the exception of Policy Standards 13.2.B, and 13.4.B, which were not approved by OCRM for federal agency consistency review purposes only). Other changes to the State's enforceable policies based on the Town of Somerset LWRP are essentially the same as those found in State law under 19 NYCRR, Part 600.5., unless the State Policy was found to be not applicable to the Town of Somerset. In addition, OCRM has concurred on the minor modification to the existing State Coastal Area Boundary as identified in the Town of Somerset LWRP, as follows: Extend the landward NYS Coastal Management Program Boundary south to include 1,350 acres between Lake Road (Route 18) and Haight Road, bounded by the Town Line on the west and Hartland Road on the east.
Pursuant to the State Coastal Management Program and Article 42 of the New York State Executive Law, the Town of Somerset LWRP was adopted by the Town Board by resolution on August 9, 2005 and approved by the New York State Secretary of State on December 13, 2005.
Federal consistency with the Town of Somerset LWRP applies as of the date of this notice.
Copies of the LWRP are available for review at the offices of the Department of State, Division of Coastal Resources, 41 State St., Albany, NY 12231. For further information, please contact Jeffrey Beach, Department of State, Division of Coastal Resources at (518) 473-2472.
