NOTICE OF PUBLIC HEARING
Power Authority of the State of New York
The New York Power Authority (“Authority”) will hold a public hearing on Wednesday, January 16, 2008, commencing consideration of Fuel Sources, Fossil Fuel Generation Efficiency and Net Metering standards (“Standards”) as required by the federal Energy Policy Act of 2005 (“EPACT”). The Authority, as a non-regulated electric utility under the requirements of EPACT, must complete consideration of the Standards and make a determination as to whether to adopt the Standards by August 8, 2008. The public hearing will provide interested parties with an opportunity to provide comments to the Authority with respect to whether and how the Standards should be adopted.
The Authority will conduct the January 16, 2008, hearing at 10:30 a.m. in the Jaguar Room of its administrative office building at 123 Main Street, White Plains, New York. The New York State Office of Alcoholism and Substance Abuse Services (OASAS) hereby gives notice, pursuant to Section 1941 of the Public Health Service Act, of the opportunity for public review of the “Federal Substance Abuse Prevention and Treatment Block Grant -Federal Fiscal Year (FFY) 2008 Annual Synar Report” (Synar Report), which describes New York State's compliance with Federal requirements regarding the sale of tobacco products to youth under the age of 18.

Department of Health Applications Being Accepted from Licensed Nursing Homes for 25 Adult Day Health Care Program Slots in Tompkins and Niagara Counties
The Department of Health is issuing this Request for Proposal (RFP) to solicit applications from licensed nursing homes in Tompkins and/or Niagara Counties for 25 Adult Day Health Care Program (ADHCP) slots for each county.
A copy of the RFP is available on the Department's web site. The guidelines for review of the Certificate of Need (CON) program narrative are also available on the web site and contain the CON schedules that will be required as part of the application.
Complete applications may be submitted by licensed nursing homes and will be accepted until 3:00 p.m. on December 28, 2007.

Department of Taxation and Finance Tax Law Article 13-A Rates
Pursuant to the provisions of subdivisions (e), (f), (g) and (h) of section 301-a, subdivision (b) of section 301-d, subdivisions (b) and (c) of section 301-e, subdivisions (a) and (c) of section 301-j and subdivision (a) of section 308 of the Tax Law, the Acting Commissioner of Taxation and Finance hereby gives public notice regarding the petroleum business tax (Tax Law, Article 13-A) rate adjustment calculation and the resulting rates effective January 1, 2008 (effective March 1, 2008 for quarterly filers) as follows: The motor fuel and automotive-type diesel motor fuel rate is adjusted from $.100 to $.099; the nonautomotive-type diesel motor fuel rate is adjusted from $.090 to $.089; the residual petroleum product rate is adjusted from $.069 to $.068; the kero-jet fuel rate is adjusted from $.066 to $.065; the aviation gasoline rate is adjusted from $.100 to $.099; the rate of the supplemental tax on aviation gasoline is adjusted from $.066 to $.065; and the rate of the supplemental petroleum business tax is adjusted from $.066 to $.065. The separate rate of supplemental petroleum business tax with respect to automotive-type diesel motor fuel is adjusted from $.0485 to $.0475; it is computed by subtracting one and three-quarters cents from the adjusted rate of the supplemental petroleum business tax. The railroad diesel rate is adjusted from $.087 to $.086; it is computed by subtracting one and three-tenths cents from the motor fuel and automotive-type diesel motor fuel rate.
The utility credit (or reimbursement) rate with respect to residual petroleum product is adjusted from $.0548 to $.0541 and the utility credit (or reimbursement) rate with respect to unenhanced diesel product is adjusted from $.0552 to $.0545. The utility credit (or reimbursement) rates are further adjusted by adding one-half of one cent to the adjusted rates of the utility credits (or reimbursements); the utility credit (or reimbursement) rate with respect to residual petroleum product is further adjusted from $.0598 to $.0591, and the utility credit (or reimbursement) rate with respect to unenhanced diesel product is further adjusted from $.0602 to $.0595.
The adjusted petroleum business tax rates are obtained by multiplying the existing rates by a fraction, the numerator of which is the sum of the monthly producer price indices (unadjusted) for refined petroleum products for the twelve consecutive months ending with the month of August 2007, and the denominator of which is the sum of the monthly producer price indices (unadjusted) for refined petroleum products for the twelve consecutive months ending with the month of August 2006. Such monthly producer price indices for the twelve consecutive months ending with the month of August 2007, are 185.1, 172.3, 172.2, 175.2, 163.2, 171.1, 194.1, 214.4, 230.1, 221.8, 233.4, and 213.0, which total 2345.9. Such monthly producer price indices for the twelve consecutive months ending with the month of August 2006, are 200.7, 214.9, 171.5, 172.1, 177.2, 169.3, 184.6, 207.4, 215.6, 220.5, 220.3, and 220.4 which total 2374.5. The producer price index for the category of commodities designated as refined petroleum products is published monthly by the Bureau of Labor Statistics of the U.S. Department of Labor. As required by law, the adjusted rates, except the utility credit (or reimbursement) rates and the rate of supplemental petroleum business tax with respect to automotive-type diesel motor fuel, have been rounded to the nearest tenth of one cent. The utility credit (or reimbursement) rates and the rate of supplemental petroleum business tax with respect to automotive-type diesel motor fuel have been rounded to the nearest hundredth of one cent. Section 301-a of the Tax Law does not allow the rates to change by more than 5 percent of the rates in effect on December 31. The computed rate change was about 1.2 percent; none of the above rates were subject to this limitation.
