Municipal Agricultural and Farmland Protection Plans
The Department of Agriculture and Markets is announcing the availability of funds to assist with the development of Municipal Agricultural and Farmland Protection Plans. Municipalities include towns, villages and cities. Municipal participation is voluntary and applications for funds must be made by the chair of the municipal governing body. Applications will be accepted on a continuing basis subject to the availability of funds. This program is intended to promote the development of municipal based plans and programs that are designed to recognize and protect the environmental and landscape preservation values associated with agriculture and make an effort to maintain the economic viability of the State's agricultural industry and its agricultural land base. Article 25-AAA of the Agriculture and Markets Law recognizes the external pressures being exerted on the stability of farming from competing non-agricultural interests and establishes a procedure whereby local agricultural and farmland protection programs can be developed or enhanced. Interested municipalities have the opportunity to apply for grants, up to $25,000 per municipality to develop an agricultural and farmland protection plan. Two municipalities may apply jointly for a total of $50,000. Those municipalities submitting grant applications will be required to provide a twenty-five percent (25%) match of cash or in-kind services. A minimum of twenty percent (20%) of that match must be cash. In-kind contributions will be accepted for all eligible cost categories. Indirect and overhead charges and volunteer services will not be accepted as a match. Once a municipal plan is completed, it must be submitted to the municipal legislative body for review and once approved, submitted to the county agricultural and farmland protection board and the Commissioner of Agriculture and Markets for approval. The Request for Applications (RFA) will be posted in the “Funding Opportunities” section of the Department's web site on Wednesday, September 26, 2007.

MUNICIPALITIES WITH GAS COLLECTION SYSTEM AT CLOSED LANDFILL
Landfill Closure State Assistance Program
Applications will be accepted continuously. The program is for municipal owners or operators of landfills who have incurred costs associated with the design and construction of active landfill gas collection and treatment systems. They will be eligible to recover up to 50 percent of the associated costs, up to a maximum of two million dollars. Eligible costs include: design and construction of gas collection and conveyance systems, and purchase and installation of stationary flares, internal combustion engines or turbines used to treat (burn) the landfill gas. The program is authorized by ECL Article 55, Title 4 and Article 54, Title 5.

MUNICIPALITIES WITH A LANDFILL UNDER ORDER TO CLOSE
Landfill Closure State Assistance Program
Applications will be accepted continuously. The program is for municipalities with inactive solid waste landfills or landfills that will be inactive within 18 months of application that have eligible closure costs incurred after April 1, 1993. They will be eligible to recover up to 50 percent of the eligible costs (90 percent for municipalities with populations less than 3,500) up to a maximum of two million dollars. The program is authorized by ECL Article 56, Title 4 and Article 54, Title 5, with specific requirements detailed in 6 NYCRR Subpart 360-9.
