Department of Health
The New York State Department of Health (DOH) is required by the provisions of the federal Beaches Environmental Assessment and Coastal Health (BEACH) Act to provide for public review and comment on the Department's beach monitoring and notification plan. The BEACH Act (Section 406(b) of the Clean Water Act) enacted a federal Environmental Protection Agency grant program available to states, such as New York, with coastal recreational waters. Coastal recreational waters include the Great Lakes and marine coastal waters that are designated for swimming, bathing, surfing, or similar water contact activities. The Act is not applicable to inland waters or waters upstream of the mouth of a river or stream having an unimpaired natural connection with the open sea.
The beach monitoring and public notification plan also includes information on the beach evaluation and classification process, including a list of waters to be monitored and beach ranking. Also included in this plan, is the sampling design and monitoring plan, including sampling location and sampling frequency. Lastly, the plan contains information on procedures for public notification and risk communication, including methods to notify the public of a swimming advisory or beach closure.

The New York State Department of State (DOS) is required by Federal regulations to provide timely public notice for the activities described below, which are subject to the consistency provisions of the Federal Coastal Zone Management Act of 1972, as amended.
The applicant has certified that the proposed activity complies with and will be conducted in a manner consistent with the approved New York State Coastal Management Program. The applicant's consistency certification and accompanying public information and data are available for inspection at the New York State Department of State offices located at 41 State Street in Albany, New York.
In F-2007-0286, Mark Teitelbaum is proposing the construction of a new, private, recreational dock consisting of a 4-foot wide by 233-foot long elevated catwalk, a 2.5-foot wide by 32-foot long hinged ramp, and an 8-foot wide by 20-foot long float. The proposed structure would be constructed along the shoreline of Conscience Bay on and adjacent to his property at 3 North Road, in the Town of Brookhaven, Suffolk County, New York. Conscience Bay is a part of the State-designated Conscience Bay, Little Bay, and Setauket Harbor Significant Coastal Fish and Wildlife Habitat.

In F-2007-0440, Laurence Eliais proposing acombination of shore line stabilization measures along the Lake Ontario Shoreline at 433 Lake Road, in the Town of Porter, in Niagara County, New York. The proposed plans include approximately 420 linear feet of new stone rip-rap on the West and East sides of the property, maintenance and cleanup of approximately 520 linear feet of existing rip-rap along the shoreline. The proposed activity would be undertaken in a State designated Coastal Erosion Hazard Area (CEHA), designated in accordance with Article 34 of the State Environmental Conservation Law and its implementing regulations in 6 NYCRR Part 505. Specifically, the beach, bluff, and nearshore area where the activity is proposed are natural protective features, and the area is a designated “Natural Protective Feature Area” delineated on the official New York State Department of Environmental Conservation Coastal Erosion Hazard Area Map Photo Number 170-797, sheet 1 of 8.
