363.10 Out-of-state physician; out-of-state podiatrist; out-of-state chiropractor; out-of-state dentist. Statement of disability.

(a) If a claimant who is entitled to benefits under the Disability Benefits Law, Workers' Compensation Law, art. 9, resides outside New York State and is regularly under the care of his physician, podiatrist, chiropractor, or dentist in the place of his residence, the statement of such physician may be accepted as proof of disability.
(b) If a claimant who is entitled to benefits under the Disability Benefits Law resides outside New York State and is regularly under the care of his podiatrist in the place of his residence, the statement of such podiatrist may be accepted as proof of disability in connection with any condition which may lawfully be treated by a duly registered and licensed podiatrist of the State of New York.
(c) If a claimant who is entitled to benefits under the Disability Benefits Law resides outside New York State and is regularly under the care of his chiropractor in the place of his residence, the statement of such chiropractor may be accepted as proof of disability in connection with any condition which may lawfully be treated by a duly registered and licensed chiropractor of the State of New York, but shall not be controlling.
(d) If a claimant who is entitled to benefits under the Disability Benefits Law resides outside New York State and is regularly under the care of his dentist in the place of his residence, the statement of such dentist may be accepted as proof of disability in connection with any condition which may lawfully be treated by a duly licensed dentist of the State of New York.
(e) The chairman may by rule prescribe exceptions.
