Type II Actions include:
(1) All actions designated as Type II in 6 NYCRR 617.12.
(2) Any resolution of a conflict between agencies as to the order of priority with respect to the exercise of a preferential right of acquisition.
(3) The execution of a lease for the use of Authority owned property where such lease provides for the use of the land and/or structures in their present condition.
(4) The sale or disposal of:
a.) Buildings located on property which has been acquired for transportation purposes.
b.) Authority owned land which has been determined to be surplus to transportation needs.
(5) Preparing, maintaining and updating manuals, directives, procedures, guidelines, etc., which do not commit the Authority to undertake new programs and which do not involve a major reordering of priorities.
(6) Review of environmental impact statements prepared by others.
(7) The conduct of studies and the establishment of standards including:
a.) Engineering research studies to evaluate materials, methods, equipment and procedures.
b.) Establishing quality standards for engineering materials in accordance with accepted engineering practices.
c.) Preparation of soil and water inventories.
d.) Establishment of equipment construction standards for buses.
e.) Conducting studies to determine efficiency and safety of existing transportation systems.
(8) Defining the scope of services, negotiating and executing contracts with consultants for professional services.
(9) Training and training programs.
(10) The conduct, preparation, or approval of technical, engineering, economic, planning, environmental, feasibility or research studies, reports or memoranda which do not commit the Authority to undertake specific programs or activities.
(11) Planning, budgeting, cost estimation, preparation of work programs and other project process activities.
(12) Approval or adoption of plans, grants, contracts, or permits to restore, construct, reconstruct, improve or replace, at existing sites, existing transportation facilities or structures, which do not involve expansion by more than fifty percent of existing size or usage.
(13) Approval or adoption of plans, grants, contracts, or permits to construct, replace, rehabilitate, or convert existing transportation equipment or to expand an existing fleet of equipment by no more than fifty percent.
(14) Approval and execution of grants or contracts to prepare transportation or master plans or studies, or transportation project or program plans or studies, which do not commit the Authority to undertake specific programs or activities.
(15) Preparation and adoption of new or revised comprehensive transportation or master plans studies, or programs which do not commit the Authority to undertake specific programs or activities.
(16) Construction of:
a.) New parking areas or facilities for less than 250 cars.
b.) New parking areas or facilities for more than 250 cars provided that an indirect source permit is not required.
(17) The expansion or the approval and execution of a grant for the expansion of parking areas or facilities by not more than 50% in size or usage provided that an indirect source permit is not required.
(18) Approval and execution of airport development contracts or grants for:
a.) The purchase or construction of fire/crash/rescue vehicles buildings, and other safety equipment to meet federal airport certification requirements.
b.) Installation of fencing.
c.) Construction of segmented circles.
d.) Purchase and installation of wind or landing direction indicators.
e.) Runway and taxiway marking and grooving.
f.) The purchase of security equipment.
g.) The purchase and/or construction of pedestrian and people moving facilities and baggage handling facilities to be located within existing airport boundaries.
h.) The construction of taxi fillets and jet blast facilities for existing runways, taxiways and aprons within existing Airport boundaries.
i.) The purchase and installation of lighting systems.
j.) The purchase of visual and electronic approach aids.
k.) The purchase of communication equipment.
l.) The purchase of weather and other atmospheric measuring equipment and/or services.
(19) Execution of grants or contracts for the installation of fencing at hazardous locations along existing railroad right-of-way.
(20) Execution of agreements or contracts for the subsidization of existing transportation operations or service or for the expansion of such operations or service by less than fifty percent.
(21) Execution of agreements or contracts for:
a.) The purchase of fare boxes, maintenance equipment, bus shelters, two-way radios, supervisory vehicles and associated equipment.
b.) The purchase of 25 or fewer new buses to begin new service or to expand an existing fleet.
(22) The establishment, operation and administration of carpooling or vanpooling programs.
(23) The preparation and approval of documents certifying compliance with Federal process requirements, preliminary to the formulation of proposal(s) for action(s).
(24) Acceptance, rejection, approval or denial by the Chairman or his duly authorized agent of:
a.) Tariffs and/or amendments thereto.
b.) Contract carriage contracts.
c.) Schedules of minimum charges.
d.) Operating agreements.
e.) Leases or conveyances of operating authority or lines.
f.) Issuances of indebtedness.
g.) Reorganization, mergers, acquisitions or transfers of operating authority, franchises, or stocks.
h.) Self-insurance funding provisions and regular insurance agreements.
(25) Approval or denial of requests for reductions or increases in the service frequency of bus lines.
(26) Decisions and actions involving the repair, restoration or reconstruction of a railroad crossing, at, above or below grade, when such crossing is being increased or expanded by less than fifty percent of its existing size or usage.
(27) Any determination to pay, or agreement to pay and the payment of any subsidy to a railroad, bus line or motor carrier or other transportation mode for the purpose of maintaining existing levels or service or to prevent the abandonment or discontinuance of existing levels of service.
(28) All routine administration, coordination, review and management activities of the Authority.
(29) Any other construction or activity that has little or no significant impact on the quality of the environment.
Note to Appendix C: With respect to capital construction projects, many activities which might have been listed in this appendix as Type II actions are the components of a project. These components may occur in the programming stage, the planning stage, the design stage or the construction stage. The entire project will be considered the "action" for the purpose of SEQR analysis. If impact statement analysis is determined to be necessary, only one draft and one final environmental impact statement will be prepared for the entire project.
