1035.4 Suspension of service.
(a) The authority may suspend, for a reasonable period of time, paratransit service to an eligible individual for the following reasons:
(1) a pattern of missing scheduled trips;
(2) failure to pay the fare;
(3) violent, seriously disruptive, or illegal conduct during a paratransit trip; or
(4) failure to follow any rule of conduct that is established.
(b) Except for suspensions for violent or seriously disruptive conduct, before suspending service, the authority shall:
(1) notify the individual in writing that the authority proposes to suspend service, citing with specificity the basis of the proposed suspension and setting forth the proposed sanction;
(2) provide the individual with an opportunity to be heard and to present information and arguments; and
(3) provide the individual with written notification of the decision and the reasons for it.
(c) In the case of suspensions for violent, seriously disruptive or illegal conduct during a paratransit trip, an individual will be subject to immediate suspension, but will be entitled to a post-suspension hearing, which shall in all other respects conform to the procedures for pre-suspension hearings set forth in subdivision (b) of this section.
(d) The appeal process of section 1035.3(i)-(l) of this Part is available to individuals who have been suspended pursuant to this section. Except for suspensions for violent, seriously disruptive or illegal conduct, the suspension will not be imposed pending the outcome of the appeal.
