1035.1 Definitions.
Unless expressly otherwise provided, the following terms as used in these rules shall have the following meanings:
(a) ADA means the paratransit requirements of the Americans with Disabilities Act (42 USC section 12143) and regulations promulgated by the United States Department of Transportation (49 CFR section 37.121 et seq.) as they may be amended from time to time.
(b) Accessible format means print and audio tape presentation methods for persons with visual impairments.
(c) Advance reservation service means a type of paratransit service by which ADA paratransit-eligible individuals arrange for paratransit trips in advance during the trip reservation periods specified in section 1035.7(b) of this Part.
(d) Authority means the New York City Transit Authority, the Manhattan and Bronx Surface Transit Operating Authority and the Staten Island Rapid Transit Operating Authority.
(e) Disability means, with respect to an individual:
(1) a physical or mental impairment that substantially limits an individual's ability to travel independently on fixed-route transportation services:
(i) the phrase physical or mental impairment means:
(a) any physiological disorder or condition or anatomical loss affecting one or more of the following body systems: neurological, musculoskeletal, special sense organs, respiratory, cardiovascular, digestive, genito-urinary, hemic and lymphatic, skin and endocrine;
(b) any mental or psychological disorder, such as mental retardation, organic brain syndrome, emotional or mental illness, and specific learning disabilities; and
(c) any physiological, mental or psychological disorder including, but not limited to, such contagious or noncontagious diseases and conditions as orthopedic, visual, speech and hearing impairments; cerebral palsy, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, mental retardation, emotional illness, specific learning disabilities, HIV disease, tuberculosis, drug addiction and alcoholism.
(f) Fixed route transportation services means the rapid transit service provided by the authority and the local bus service provided by the authority and by private operators franchised by the city of New York, all of which services operate along fixed routes according to prescribed schedules. Fixed route transportation does not include express bus service.
(g) Operates includes, with respect to paratransit, the provision of transportation service by the New York City Transit Authority or by a person or firm under a contractual or other arrangement or relationship with it, or by any other public authority or entity designated by the Metropolitan Transportation Authority.
(h) Paratransit means a specialized, demand-responsive, origin-to-destination transportation service to be operated by the New York City Transit Authority for individuals with disabilities who are unable to use fixed-route transportation systems in New York City.
(i) Subscription service means a type of paratransit by which ADA-paratransit-eligible individuals who regularly require paratransit for the same origins and destinations for the same days each week and at the same times of day may be deemed eligible to receive those trips without being required to make an advance reservation for each trip.
