(a) A sample of the vehicular traffic hazard warning device, including instructions for installing, shall be shipped, postage prepaid, to the Commissioner of Motor Vehicles, Albany, New York, together with a certificate and report of testing results from any unbiased laboratory acceptable to the commissioner, that such device meets the requirements of this Part.

(b) In lieu of approval under subdivision (a) of this section, approval shall be deemed to be granted upon the receipt by the Commissioner of Motor Vehicles of a certificate of equipment approval issued by the American Association of Motor Vehicle Administrators to the Commissioner of Motor Vehicles, Bureau of Technical Assessment, Empire State Plaza, Albany, N.Y. 12228.
