43.7 Approval of equipment.
(a) All equipment required by section 376 of the Vehicle and Traffic Law shall be of a type approved by the commissioner.
(b) All headlamps, directional signals, reflectors, stop lamps, number plate lamps, backup lamps, tail lamps, parking lamps, hazardous warning devices, identification lamps, clearance lamps and side marker lamps will be approved by the commissioner if such lamps have the lens markings required by Federal Motor Vehicle Safety Standard 108 (49 CFR 571.108) and conform to the specifications established by the Society of Automotive Engineers for such equipment. Such specifications are adopted as the standards for approval for the purposes of this Part, but a sample of such equipment accompanied by a report prepared by a recognized testing laboratory must be submitted to the commissioner and specific approval obtained.
(c) In lieu of approval under subdivision (a) of this section, approval shall be deemed to be granted upon the receipt by the Commissioner of Motor Vehicles of a certificate of equipment approval issued by the Automotive Manufacturers Equipment Compliance Agency, Inc. (A.M.E.C.A.) to the Commissioner of Motor Vehicles, Bureau of Technical Assessment, Empire State Plaza, Albany, NY 12228.
