41.2 Auxiliary (hand) brake standard.
Auxiliary brakes on every motor vehicle and every combination of motor vehicle and trailer, operated on a public highway, should be capable at least of holding the vehicle or combination at rest on any grade upon which they may be operated, accordingly:
Such brakes on every passenger vehicle of less than eight passengers capacity, and on every other motor vehicle or combination of motor vehicle and trailer on which the braking effort is applied to drums mounted on the wheels or a jack shaft, shall be capable of stopping the vehicle or combination by reducing its speed at a rate sufficient to bring it to a stop from a speed of 20 miles per hour on a hard, dry, approximately level pavement, substantially free from loose material, within a distance of 75 feet; and such brakes on every motor vehicle or combination of motor vehicle and trailer, except passenger vehicles of less than eight passengers capacity, on which the braking effort is applied to a drum or drums mounted on part of the propelling mechanism, except a jack shaft, shall at least be capable of holding the vehicle or combination with its load on a 25 percent grade or of withstanding a force equal to 25 percent of the total weight and carrying capacity of the vehicle or combination when tested on a dynamometer type of brake tester.
