671.2 Applicability.
(a) This Part contains requirements and specifications relative to the provision of the home and community-based services (HCBS) waiver community residential habilitation services delivered in certified community residences as authorized by the Secretary of the United States Department of Health and Human Services pursuant to section 1915(c) of the Social Security Act (see glossary).
(b) All providers of home and community-based waiver services shall be authorized pursuant to a Medicaid provider agreement issued and approved by the New York State Department of Social Services specific to the type of services being offered.
(c) In addition, all authorized HCBS waiver community residential habilitation providers shall comply with the requirements of Parts 624 and 633 of this Title.
(d) In order to receive authorization from OPWDD to provide community residential habilitation services, a provider shall:
(1) hold a valid operating certificate from OPWDD as a supervised or supportive community residence; and
(2) be issued a specific authorized provider medical assistance reimbursement number.
