(a) This Part shall apply to any applicant, as defined herein eligible for, or seeking to obtain, a State aid grant, a mortgage loan from the Facilities Development Corporation and/or a mortgage loan from the Housing Finance Agency for the purpose of funding the eligible capital costs associated with the acquisition, construction, reconstruction or rehabilitation of a community mental health facility, pursuant to articles 41 and/or 75 of the Mental Hygiene Law.

(b) This Part supersedes Part 101 of this Title as it relates to community facilities where services for the mentally ill are provided in accordance with the Office of Mental Health's standards.
