304.1 Introduction.
(a) Since the decriminalization of public intoxication in 1976, a number of different types of services have been established in New York State to provide for the welfare of persons intoxicated in public who, for whatever reason, cannot be taken to their homes or residences. In accordance with the provisions of section 21.09 of the Mental Hygiene Law, all services for this purpose are required to be approved by the commissioner.
(b) In accordance with the provisions of section 21.09 of the Mental Hygiene Law, this Part deals with two classes of public inebriates; section 304.3 of this Part relates specifically to persons who are only intoxicated, while section 304.4 of this Part relates specifically to persons who are incapacitated by alcohol.
