476.1 Appointments of investigative specialists in Bureau of Criminal Investigation.
(a) The Executive Law provides for the assignment of members of the New York State Police to the Bureau of Criminal Investigation and for the appointment of investigative specialists to the Bureau of Criminal Investigation.
(b) Appointments of investigative specialists to the positions of investigator and senior investigator in the Bureau of Criminal Investigation may be made by the superintendent when such appointments are determined by him to be in the best interests of the New York State Police.
(c) For appointment as an investigative specialist, an applicant must be of good moral character and must have educational and other qualifications determined by the superintendent.
(d) Applicants will be required to take a noncompetitive examination and must meet such other standards as are set by the superintendent.
(e) Appointments shall be probationary for a period of 52 weeks.
(f) If the conduct, performance, physical condition or health of the member at any time during his probationary period is not satisfactory, his employment may be terminated by the superintendent.
(g) If the termination of employment by the superintendent during the probationary period is for any reason other than unsatisfactory conduct, notice shall be given to the probationer one week in advance of termination; or, in lieu thereof, a lump sum payment may be made equivalent to the salary of the probationer for one week.
