381.16 Low-level radioactive waste accidents or incidents.
(a) In the event of an accident or incident involving the transport of low-level radioactive waste within the State of New York, the transporter must take appropriate immediate action to protect human health and the environment. Any suspected or actual uncontrolled releases of radiation are to be immediately reported to the department and the New York State Department of Health.
(b) A transporter must take such action as may be required or approved by Federal, State or local officials so that the low-level radioactive waste incident or accident no longer presents a hazard to human health or the environment.
