232.15 Permitting and compliance.
Part 201 of this Title (Permitting Requirements) applies to all new and existing perc dry cleaners subject to this Part.
(a) Any person proposing to construct a new perc dry cleaning facility, or make modifications to existing systems that are not required in order to comply with the equipment standards under section 232.6 of this Part, must apply for a permit and receive department approval in accordance with Part 201 before commencing construction or installation, except as provided for in the pre-permitting requirements for existing facilities (section 232.5 of this Part).
(b) Any person who owns an existing facility subject to this Part must take one or more of the following actions within the time periods specified below in order to inform the department of the compliance status of their facility and obtain permits as required under Part 201 of this Title as of the effective date of this Part. Those facilities previously exempted under Part 201 of this Title, and therefore not currently required to have permits to operate existing dry cleaning systems, will be considered to be in compliance with Part 201 of this Title provided the following provisions are complied with.
(1) Submit to the department written notification of the termination of operation of each dry cleaning system at the facility that must be replaced as required by this Part on or before the 30th day following the compliance deadlines established in section 232.6 of this Part. Such notification must be submitted to the department by means of certified mail, return receipt requested.
(2) For existing facilities that are in compliance with equipment standards under section 232.6 of this Part, the owner must obtain a registration in accordance with Subpart 201-4 of this Title to continue to operate the dry cleaning systems. Registration applications must be submitted at least 60 calendar days in advance of the applicable compliance deadline.
(3) For existing facilities where dry cleaning systems must be modified or replaced in order to comply with equipment standards under section 232.6 of this Part, registration applications must be submitted to the department at least 90 calendar days in advance of the applicable compliance deadlines.
(c) Notwithstanding the provisions in subdivisions (a) and (b) of this section, perc dry cleaning facilities that are major stationary sources must comply with all requirements under Part 201 of this Title with regard to obtaining a Title V facility permit.
