60.2 Intrastate movement of deer.
(a) No deer shall be transported on any public highway within New York State unless a permit is obtained from the department prior to movement by contacting:

and
(1) the herd of origin is certified as tuberculosis free by the commissioner; or
(2) the herd of origin has been tested and the results were negative to a cervical tuberculosis test within the 12-month period preceding movement; or
(3) the deer has been tested and the results were negative to a cervical tuberculosis test, a U.S.D.A. approved deer tuberculosis test or a BTB within 60 days prior to movement. However, if any deer in the herd of origin is a suspect or reactor, no deer shall be moved until the commissioner determines that the herd is not tuberculosis infected. The provisions of this paragraph shall not apply to deer under 180 days of age.
(b) The provisions of this section shall not apply to:
(1) deer that are moved as part of the Department of Environmental Conservation deer management program; or
(2) deer transferred between pastures on the same premises; or
(3) deer that are moved directly to slaughter, except that such deer must be held separate and apart from all other livestock during transportation and shall be slaughtered within 10 days of movement.
