Except as hereinafter specifically provided, approval by the commissioner is not required in respect to a passenger tramway or any material or device associated therewith. A material or device which the board (prior to 1975) or commissioner has approved pursuant to section 21 of the Labor Law for use in complying with this Part may be used, subject to the requirement of the resolution of approval, as if by the Part specifically authorized, any general or special provision of this Part notwithstanding.
